Form I-9 Central: New Employer Handbook and New Rule Reminder

The U.S. Citizenship and Immigration Service (USCIS) has two important announcements for your clients this month – there’s a reminder of a new rule amending Department of Homeland Security regulations and a new I-9 Employer handbook. 


Now in effect: New rule affecting Form I-9 completion for certain employees 

Retention of EB-1, EB-2, and EB-3 Immigrant Workers and Program Improvements Affecting High-Skilled Nonimmigrant Workers went into effect in January. It provides automatic extension of the validity periods of certain Employment Authorization Documents (Form I-766) for up to 180 days if the employee:

• Filed in time to renew Form I-766, Employment Authorization Document (EAD)
• Applied to renew such EAD in the same category as the previous EAD (A12 and C19 are considered the same category for this extension); and
• Is in a category that is eligible for the extension

The updated I-9 handbook for your clients is now available 

The new, revised Handbook for Employers: Guidance for Completing Form I-9 gives you and your clients details on completing Form I-9, Employment Eligibility Verification. This version, which published January 22, 2017, replaces the previous version, which was published on April 30, 2013. It reflects revisions to Form I-9, which was revised on November 14, 2016. Review the updated Handbook for Employers or see the Table of Changes for Revised M-274 (PDF, 495 KB) for highlights of the changes.
